RENTAL TERMS AND CONDITIONS

Definitions

For the purposes of this Agreement:

  • “Rented Equipment” refers to any and all equipment, products, and related items provided by The Happy Nest to the Client.
  • “Client” refers to any individual or entity that reserves or rents equipment from the Company.
  • “Company” refers to The Happy Nest, a limited liability company organized under the laws of Saint Lucia, with its principal place of business in Choiseul, Saint Lucia.
  • “Rental Period” refers to the agreed duration for which the Rented Equipment is provided, including any extension resulting from late return.
  • “Business Days” refer to Monday through Friday, excluding weekends and public holidays.

Rental of Equipment and Duration

  • The Company agrees to provide, and the Client agrees to rent, the Rented Equipment specified in the confirmed reservation.
  • Delivery fees are applicable as follows: $60 for the South and $15 for the North. Delivery and setup may be facilitated by the Company as a courtesy; however, the Client retains full responsibility for ensuring that all equipment is properly installed and safely used.
  • The Rental Period shall automatically extend in the event that equipment is not returned at the agreed date and time. The Client shall be liable for all additional charges incurred as a result of such extension.
  • Requests for extension must be communicated in advance and are subject to approval at the sole discretion of the Company. Approved extensions will be charged at the applicable daily rate.
  • Late returns may result in additional rental charges and/or penalties as determined by the Company.
  • At least 36 hours prior to delivery, Client will notify company of: (a) the location and date and time when Client wants the rented Equipment delivered; and (b) the name of the person who is authorised to accept delivery. Client is responsible for making any and all arrangements for that agent or delegate to accept the Rented Equipment.

Fees, Payments, and Reservations

  • All fees are due at the time a reservation is made. Fees will vary depending upon the length of rental and the types and amounts of the Rented Equipment. Client understands and agrees that Client’s credit card will be charged for the full rental amount of the Rented Equipment and delivery charge at the time of reservation.
  • All reservations are subject to confirmation by the Company within forty-eight (48) hours.
  • All rental fees are strictly non-refundable once the Rental Period has commenced, except where expressly provided in this Agreement.

Early Return & Refund Policy

  1. Notification Requirement
    • Clients must provide written notice (via email or direct message) prior to the end of the Rental Period in the event of an early return.
  2. Refund Eligibility
    • Refunds for early returns are not automatic and will be considered on a case-by-case basis.
    • Refunds will only be granted if the early return is communicated before the rental period ends.
    • If no prior notice is given, The Happy Nest reserves the right to deny refunds for unused days.
  3. Partial Refund Consideration
    • If a refund for an early return is approved, a partial refund may be granted based on:
      a) The number of unused rental days.
      b) The time of notification (earlier notices may receive higher refunds).
      c) Whether the items were available for rebooking during the unused period.
      d) Any administrative or processing fees incurred.
  4. Security Deposit
    • A refundable security deposit is required and shall be returned subject to satisfactory inspection of all Rented Equipment.
    • The security deposit may be partially or fully withheld in instances including, but not limited to:
      • Damage or breakage
      • Loss or missing components
      • Excessive soiling
      • Misuse or improper handling
      • Late return of equipment.
    • All returned equipment shall be subject to inspection.
    • Refundable deposits will be processed within up to seven (7) business days following the conclusion of the Rental Period. This timeframe allows for inspection, cleaning, and quality assurance procedures.
    • Following processing, refunds may take an additional three (3) to five (5) business days to be reflected, depending on the Client’s financial institution or payment provider.
    • Refunds will be issued via the original method of payment unless otherwise agreed in writing.
  5. Exceptions & Special Circumstances
    • While The Happy Nest understands that emergencies happen, refunds for early departures due to unforeseen circumstances (e.g., medical issues, travel changes) will still require timely communication.
    • If an early return is due to exceptional circumstances, The Happy Nest may offer a store credit instead of a refund at its discretion.
  6. Refund Processing Schedule (Bank Transfers)
    • Due to applicable processing charges, banking timelines, and administrative procedures, any refunds issued via bank transfer will be processed on a scheduled basis.
    • The Company processes bank transfer refunds on the 1st and 15th of each month. Where either date falls on a non-business day, processing will occur on the next business day.
    • Clients acknowledge and agree that the timing of such refunds is subject to this schedule and that additional processing time may be required by the receiving financial institution.
    • By proceeding with a booking, the Client agrees to the Company’s fixed refund schedule for bank transfers and waives any claim for expedited processing outside of these dates.

Damaged, Lost and Soiled Equipment

  • Client agrees to pay for the replacement cost of any equipment that is not returned, is lost, or is damaged or soiled to the point that Company in its sole discretion believes that Company should not rent the equipment to other customers. Company sanitizes all gear and expects customer to return reasonably clean (i.e. food should not be caked on to any items or otherwise extremely dirty). A cleaning fee will be charged to Client for items returned that are excessively dirty. This determination will be made by Company.
  • Client authorises the Company to charge Client’s credit card for any unpaid rental fees and/or replacement fees and/or cleaning fees. The replacement fees for lost or damaged Rented Equipment will be the MSRP found on the Manufacturer’s Website.
  • Client will not be liable for ordinary wear and tear that occurs with the proper and normal use of the Rented Equipment.
  • Client agrees to inspect the Rented Equipment upon receipt, and Client hereby agrees to notify the Company immediately in the event that any of the Rented Equipment is unfit for use or of unsatisfactory condition. Client agrees that failure to notify the Company of any purported unfitness for use or unsatisfactory condition shall be deemed a waiver of any and all claims related thereto.
  • Client assumes all responsibility for the use of the Rented Equipment in accordance with those instruction manuals published by the manufacturers of the Rented Equipment, as provided to the Client by the Company. The Company is not responsible for Client’s mis-use of the Rented Equipment or the Client's failure to follow instructions and/or recommendations in instruction manuals.

Client Responsibilities

  • The Client shall:
    • Inspect all equipment upon delivery
    • Notify the Company immediately of any defects or concerns
    • Ensure that all equipment is used strictly in accordance with manufacturer guidelines and intended purpose.
  • The Client assumes full responsibility for the supervision of all individuals, including children, using the equipment.
  • Failure to report any issues at the time of delivery shall constitute acceptance of the equipment in its delivered condition.

Indemnification and Release of Liability

  • Client agrees to indemnify and hold the Company and its agents harmless from all claims, damages, losses, liabilities, judgments, and expenses (including attorneys’ fees and costs), arising out of: (a) the use of the Rented Equipment (b) any act or omission of Client, or (c) the mis-use or improper or negligent use of any Rented Equipment by Client or any third party. Client assumes any and all risks, both known and unknown, related to use of the Rented Equipment, and assumes full responsibility for any such risk
  • Client understand there are risks associated with use of the Rented Equipment.
  • Client agrees on his/her behalf and on behalf of Client's heirs, personal representatives and next of kin, to release Company and agrees not to sue the Company or Company’s officers, agents and employees, with respect to any and all bodily injury, disability, death, loss or damage whether caused by negligence of Company or otherwise.

Cancellations

  • Cancellations made at least four (4) days prior to the start of the Rental Period will receive a refund of all amounts charged (less non recoverable processing fee of approximately 3%). Cancellations made less than four (4) days but more than forty-eight (48) hours prior to the start of the Rental Period will receive a fifty percent (50%) refund of all amounts charged. There will be no refund for cancellations made less than forty-right (48) hours prior to the start of the Rental Period.

Force Majeure

  • The Company shall not be liable for any delay or failure in performance resulting from circumstances beyond its reasonable control, including but not limited to acts of God, adverse weather conditions, transportation disruptions, or other unforeseen events.

Governing Law

  • The validity, interpretation and enforceability of this Agreement shall be governed by the laws of Saint Lucia. Any action brought to enforce this Agreement shall be brought exclusively in Saint Lucia's High Court of Justice or if applicable the Caribbean Court of Justice with jurisdiction over Saint Lucia.

Severability

  • If any portion or portions of this Agreement are found to be void or unenforceable by any Court, the remaining terms of this Agreement shall remain in effect and enforceable.

Acceptance of Terms

  • By proceeding with a reservation, the Client confirms that they have read, understood, and agreed to these Terms and Conditions in their entirety. Electronic acceptance shall have the same legal effect as a written signature.

Company Commitment

  • The Happy Nest is committed to maintaining the highest standards of safety, cleanliness, and service quality, ensuring a reliable and seamless experience for all clients.

Attestation

  • I acknowledge that I have read this Agreement and Release in its entirety and voluntarily agree to and accept all terms and conditions contained herein. I further agree that my electronic or digital acceptance of this Agreement shall have the same legal effect as a handwritten signature.The Client acknowledges and agrees that by proceeding with a reservation, making a payment, or otherwise confirming a booking with The Happy Nest, they are deemed to have accepted and agreed to be bound by these Terms and Conditions in full.
